Welcome to LabHealthCharts. These Terms of Service ("Terms") contain essential terms and conditions regarding your use of our data visualization services and platform. PLEASE REVIEW THE TERMS VERY CAREFULLY BEFORE USING OUR SERVICES. We encourage you to contact us with any questions or concerns before proceeding.
Important Legal Notices
PLEASE READ THESE TERMS OF SERVICE CAREFULLY, AS THEY CONTAIN AN AGREEMENT TO ARBITRATE AND OTHER IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS. THIS AGREEMENT TO ARBITRATE REQUIRES THAT ALL DISPUTES BETWEEN YOU AND US (WITH LIMITED EXCEPTIONS) WILL BE RESOLVED BY BINDING AND FINAL ARBITRATION.
IF YOU SUBSCRIBE TO ANY FEATURE OR FUNCTIONALITY OF THE SERVICES FOR A TERM, THEN YOUR SUBSCRIPTION WILL BE AUTOMATICALLY RENEWED FOR ADDITIONAL PERIODS OF THE SAME DURATION UNLESS YOU CANCEL YOUR SUBSCRIPTION IN ACCORDANCE WITH SECTION 11 BELOW.

1. Definitions
"Affiliates" refer to an entity's executives, employees, officers, directors, agents, attorneys, representatives, partners, joint ventures, parents, subsidiaries, successors, and assigns, collectively.
"Company," "LabHealthCharts," "we," "us," and "our" all refer to Rays Health Technologies, LLC, a Delaware limited liability company.
"Personal Information" refers to information that identifies, relates to, describes, or is reasonably capable of being associated with you, as defined in our Privacy Policy.
"Platform" refers to the LabHealthCharts website (labhealthcharts.com), web application (app.labhealthcharts.com), mobile applications, and all related services, features, and technologies.
"Services" refer to all data visualization, chart creation, biomarker tracking, and related services provided through our Platform, including AI-powered PDF extraction, professional chart generation, data export functionality, and trend analysis tools.
"User Content" refers to any lab reports, PDFs, data, notes, comments, or other materials you upload, submit, or create using our Services.
"You," "your," "yourself," and "User" refers to you as an individual user of our Services.
2. LabHealthCharts Does Not Provide Medical Services
In order to use our Services, you must acknowledge and agree to the following critical limitations:

- NO MEDICAL ADVICE: LabHealthCharts does not offer medical advice, diagnosis, treatment recommendations, or any form of medical opinion through our Services or otherwise. We are a data visualization tool only.
- NOT A MEDICAL SUBSTITUTE: Our Services are not a substitute for qualified medical care, qualified medical advice, or consultation with healthcare professionals.
- NO PATIENT RELATIONSHIP: Using our Services does not create a patient-provider relationship with LabHealthCharts or any healthcare professional.
- CONSULT PROFESSIONALS: You must consult qualified healthcare professionals for all medical interpretations, decisions, diagnoses, and treatments related to your lab data.
All charts, visualizations, and data analysis provided through our Services are strictly for organizational and informational purposes. We strongly recommend that you seek the advice of qualified healthcare professionals to assist you in making decisions regarding any diagnosis, treatment, course, or care. You agree not to delay seeking care or ignore the advice of qualified medical professionals based on your use of our Services.
If you are experiencing a medical emergency, please dial 911 immediately. Our Services are not intended for emergency use or urgent medical situations.
3. Data Visualization Services and Limitations
3.1 Service Description
LabHealthCharts provides data visualization services that transform lab report PDFs into professional charts and tracking tools. Our Services include AI-powered PDF extraction, biomarker data visualization, trend analysis, professional chart generation, and data export capabilities. We support lab reports from Quest Diagnostics, LabCorp, and most major US laboratory providers.
3.2 Important Limitations
You acknowledge and accept the following limitations of our Services:
- We do not provide lab testing services or facilitate access to laboratory testing
- We do not interpret lab results or provide medical guidance about biomarker values
- Our AI extraction technology may not capture all data from complex or unusual lab report formats
- Reference ranges and normal values displayed are for informational purposes only
- Historical trend analysis does not constitute medical monitoring or care
- Data accuracy depends on the quality and format of uploaded lab reports
3.3 Data Quality and Accuracy
While we strive to provide accurate data extraction and visualization, you acknowledge that our Services may yield incomplete or inaccurate results due to variations in lab report formats, image quality, or other factors beyond our control. We do not warrant the accuracy, completeness, or reliability of extracted data or generated visualizations. You are responsible for verifying the accuracy of all extracted data against your original lab reports.
4. Eligibility and Account Requirements
4.1 Age and Capacity Requirements
Our Services are only available to individuals who are eighteen (18) years of age or older. By accessing our Services, you represent that you are of sound mind and body to agree to these Terms and possess the full rights and authorization to consent to these Terms, agree to and pay for any purchases, and submit any Personal Information provided in connection with our Services.
4.2 Account Creation
You may create a single account for yourself as an individual eighteen (18) years of age or older. To create an account, you must provide accurate, complete, and up-to-date information including your name, email address, and payment information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4.3 Prohibited Users
You may not use our Services if you are:
- Under the age of eighteen (18)
- Currently restricted or prohibited from using our Services
- A competitor of LabHealthCharts or closely connected to our competitors
- Acting on behalf of another person without proper authorization
- Under a legal obligation that restricts your use of our Services
- Otherwise unwilling to fully agree to and follow these Terms
5. Limited License to Use Our Services
5.1 Granted License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-assignable, non-transferable, and revocable license to access and use our Services for personal, non-commercial use. This license does not grant you permission to use Services requiring payment without first providing valid payment information and remitting payment as required.
5.2 Permitted Uses
You are permitted to:
- Upload your own lab reports for visualization and tracking
- Generate and download charts and visualizations of your data
- Export your data in supported formats (Excel, PDF, CSV)
- Print copies of your charts for personal use
- Store files that are automatically cached by your web browser
5.3 Account Security
You are solely responsible for maintaining the security of your account credentials and for all activities that occur under your account. We will attribute all actions taken through your account to you. You must immediately notify us of any unauthorized access to your account and maintain the confidentiality of your login information at all times.
5.4 Account Termination
You may terminate your account at any time by contacting us at support@labhealthcharts.com or through your account settings. Termination does not automatically entitle you to refunds and may result in the deletion of your account data at our discretion. We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.
6. User Representations and Prohibited Uses
6.1 General Conduct Requirements
You represent and warrant that you will use our Services in compliance with all applicable laws and these Terms. You agree to provide complete, truthful, and up-to-date information at all times and to treat LabHealthCharts, our affiliates, and other users with respect and professionalism.
6.2 Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Violating any local, state, federal, or international laws or regulations
- Uploading lab reports that do not belong to you without proper authorization
- Submitting false, misleading, or inaccurate information
- Attempting to reverse engineer, decompile, or disassemble our Services
- Using automated tools to extract data or overwhelm our systems
- Sharing your account credentials with unauthorized third parties
- Interfering with or disrupting the proper functioning of our Services
- Attempting to gain unauthorized access to our systems or other users' accounts
- Using our Services for any commercial purposes without written permission
- Redistributing or reselling access to our Services
6.3 Data Upload Responsibilities
You represent that you own or have the legal right to upload all lab reports and other data you submit to our Services. You are responsible for ensuring that any uploaded content does not violate the privacy rights of others or applicable laws. You agree not to upload lab reports belonging to minors, other individuals without consent, or any protected health information that you are not authorized to share.
7. AI Processing and Third-Party Services
7.1 AI-Powered Data Extraction
Our Services utilize artificial intelligence technology provided by OpenAI to extract biomarker data from uploaded lab report PDFs. By using our Services, you consent to the processing of your uploaded documents through these AI systems. OpenAI operates under a zero data retention policy, meaning your data is not stored or retained by OpenAI after processing is complete.
7.2 Third-Party Service Providers
We utilize various third-party service providers to deliver our Services, including payment processors (Stripe), database services (Supabase), analytics providers (Google Analytics), and hosting services. Your use of our Services may involve the processing of your data by these third parties in accordance with their respective privacy policies and our Privacy Policy.
7.3 Limitations of AI Technology
You acknowledge that AI technology has inherent limitations and may not perfectly extract all data from your lab reports. The accuracy of data extraction depends on factors including image quality, document formatting, and the complexity of the lab report layout. You are responsible for reviewing and verifying the accuracy of all extracted data before relying on it for any purpose.
8. Intellectual Property Rights
8.1 Our Intellectual Property
All intellectual property rights in our Services, including software, algorithms, user interfaces, designs, trademarks, service marks, logos, and content created by us, are owned by Rays Health Technologies, LLC or our licensors. You acknowledge that no right, title, or interest in our intellectual property is transferred to you through these Terms or your use of our Services.
8.2 Your Data Rights
You retain ownership of all lab reports, health data, and other personal information you upload to our Services. However, you grant us a limited license to process, store, and display this data as necessary to provide our Services to you. This includes the right to use AI technology to extract biomarker data and generate visualizations.
8.3 Generated Charts and Visualizations
While you own the underlying health data, the specific charts, visualizations, and analysis formats generated by our Services represent our intellectual property. You may use these materials for personal purposes but may not redistribute, commercialize, or create derivative works based on our proprietary visualization formats without written permission.
8.4 Feedback and Suggestions
Any feedback, suggestions, ideas, or other submissions you provide to us regarding our Services become our property and may be used by us without restriction or compensation to you. We may already be developing similar ideas or features at the time you submit your feedback.
9. Privacy and Data Protection
9.1 Privacy Policy
Our Privacy Policy, available at labhealthcharts.com/privacy, is incorporated into these Terms by reference. By using our Services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy. We encourage you to review our Privacy Policy carefully to understand how we handle your personal and health information.
9.2 Data Security
We implement industry-standard security measures to protect your data, including encryption at rest and in transit, access controls, and secure data processing protocols. However, no system is completely secure, and we cannot guarantee absolute security of your information. You acknowledge that you transmit data to our Services at your own risk.
9.3 Data Retention and Deletion
We retain your data indefinitely while your account is active to allow you to access your historical health tracking information. You may delete your account and all associated data at any time through your account settings or by contacting us. When you delete your account, we permanently remove all of your data from our systems, including backups, within thirty (30) days.
10. User Content and Uploads
10.1 Ownership and Rights
You retain ownership of all lab reports, documents, and other content you upload to our Services. You represent and warrant that you own or have the necessary rights to upload all content and that such uploads do not violate any third-party rights or applicable laws.
10.2 License to Process
By uploading content to our Services, you grant us a non-exclusive, worldwide license to store, process, analyze, and display your content as necessary to provide our Services. This includes using AI technology to extract data, creating visualizations, enabling data exports, and providing customer support.
10.3 Content Standards
You agree that all uploaded content will be lawful, accurate, and appropriate. You will not upload content that violates privacy laws, contains malicious code, infringes third-party rights, or is otherwise harmful or illegal. We reserve the right to remove any content that violates these standards without notice.
10.4 Responsibility for Content
You are solely responsible for all content you upload to our Services and any consequences resulting from such uploads. We do not monitor or review uploaded content in advance and disclaim any responsibility for user-generated content. You agree to indemnify us against any claims arising from your uploaded content.
11. Payment Terms and Subscriptions
11.1 Subscription Model
LabHealthCharts operates on an annual subscription model priced at $99 per year. Your subscription provides unlimited access to all Services, including unlimited lab PDF uploads, unlimited biomarker tracking, professional chart exports, and all future features. Payment is processed securely through Stripe, and we do not store your payment card information on our systems.
11.2 Automatic Renewal
Your subscription will automatically renew at the end of each subscription period at the then-current subscription fee unless you cancel your subscription before the renewal date. By subscribing, you authorize us to charge your designated payment method for recurring subscription fees. If we are unable to process payment for a renewal, we may suspend your access to the Services until payment is received.
11.3 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us at support@labhealthcharts.com. Cancellation will be effective at the end of your current billing period, and you will retain access to the Services until that time. We do not provide prorated refunds for partial billing periods.
11.4 Refund Policy
We offer a full refund if you cancel your subscription within seven (7) days of your initial purchase and have not uploaded any lab reports to our Services. After this period, all subscription fees are non-refundable. Refunds, when applicable, will be processed back to your original payment method within thirty (30) days.
11.5 Price Changes
We reserve the right to modify our subscription pricing at any time. Any price changes will be communicated to existing subscribers at least thirty (30) days before they take effect. If you do not agree to a price increase, you may cancel your subscription before the new pricing takes effect.
11.6 Taxes
You are responsible for any applicable taxes, duties, or government fees related to your subscription. If we are required to collect such taxes, they will be added to your subscription fee. You agree to provide any tax identification information we may reasonably request.
12. Disclaimers and Limitation of Liability
12.1 Service Disclaimers
OUR SERVICES ARE PROVIDED "AS IS," "WITH ALL FAULTS," AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY DATA EXTRACTION, VISUALIZATIONS, OR OTHER CONTENT PROVIDED THROUGH OUR SERVICES.
12.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU ACTUALLY PAID TO US FOR OUR SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF USE, LOST PROFITS, OR BUSINESS INTERRUPTION, REGARDLESS OF THE THEORY OF LIABILITY.
12.3 Medical Liability Disclaimer
WE ARE NOT LIABLE FOR ANY MEDICAL DECISIONS, DIAGNOSES, TREATMENTS, OR OUTCOMES BASED ON YOUR USE OF OUR SERVICES. WE DO NOT PROVIDE MEDICAL ADVICE AND ARE NOT RESPONSIBLE FOR THE MEDICAL INTERPRETATION OR USE OF ANY DATA, CHARTS, OR VISUALIZATIONS PROVIDED THROUGH OUR SERVICES.
12.4 Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, internet failures, or government actions.
13. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless LabHealthCharts, Rays Health Technologies, LLC, and our affiliates, officers, directors, employees, agents, and representatives from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising from or related to:
- Your use of our Services or violation of these Terms
- Your uploaded content or any claims that it violates third-party rights
- Any medical decisions or actions you take based on data from our Services
- Your violation of any applicable laws or regulations
- Any breach of your representations or warranties in these Terms
- Any unauthorized access to your account due to your failure to secure your credentials
- Any claims by third parties related to your use of our Services
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense. You agree to cooperate with our defense of such claims and not to settle any claim without our prior written consent.
14. Governing Law and Jurisdiction
14.1 Choice of Law
These Terms and any claims arising from or related to our Services shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles, except to the extent that Delaware law is preempted by or inconsistent with federal law.
14.2 Jurisdiction
Except to the extent that a dispute is arbitrated pursuant to Section 15 below, any legal action or proceeding arising from or related to these Terms or our Services shall be brought exclusively in the state or federal courts located in Delaware. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
14.3 International Users
Our Services are operated from the United States and are intended for users worldwide. If you are accessing our Services from outside the United States, you acknowledge that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction.
15. Dispute Resolution and Arbitration
Important Arbitration Notice
PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR RIGHTS. MOST DISPUTES BETWEEN YOU AND LABHEALTHCHARTS WILL BE RESOLVED BY BINDING AND FINAL ARBITRATION. YOU WILL ONLY BE PERMITTED TO PURSUE CLAIMS AGAINST US ON AN INDIVIDUAL BASIS, NOT AS PART OF A CLASS ACTION OR REPRESENTATIVE PROCEEDING.
15.1 Agreement to Arbitrate
Except for disputes that qualify for small claims court and claims for injunctive relief to protect intellectual property rights, any dispute, claim, or controversy arising from or related to these Terms or our Services shall be resolved exclusively through final and binding arbitration rather than in court. This arbitration agreement applies to all claims regardless of when they arose, including claims that arose before these Terms became effective.
15.2 Arbitration Rules and Process
Arbitration will be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and Mediation Procedures. The arbitration will be conducted in Delaware or another location we mutually agree upon. The arbitrator's decision will be final and binding, and judgment may be entered on the award in any court of competent jurisdiction.
15.3 Class Action Waiver
YOU AND LABHEALTHCHARTS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT ON A CLASS, REPRESENTATIVE, OR COLLECTIVE BASIS. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
15.4 Costs and Fees
Each party will bear its own attorney fees and costs in arbitration unless the arbitrator determines that a claim was frivolous or brought for an improper purpose. We will pay any AAA filing and administrative fees if you demonstrate that the costs of arbitration would be prohibitive compared to litigation costs.
15.5 Opt-Out Right
You have the right to opt out of this arbitration agreement by sending written notice to legal@labhealthcharts.com within thirty (30) days of first agreeing to these Terms. Your notice must include your name, address, and a clear statement that you want to opt out of arbitration. If you opt out, all other parts of these Terms will continue to apply.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and LabHealthCharts regarding your use of our Services and supersede all prior or contemporaneous communications, agreements, and understandings, whether oral or written.
16.2 Modification of Terms
We may modify these Terms at any time by posting the updated version on our website. Material changes will be communicated to you via email or through our Services. Your continued use of our Services after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using our Services and may cancel your account.
16.3 Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect. The unenforceable provision will be deemed modified to the minimum extent necessary to make it enforceable and preserve the intent of the original provision.
16.4 Assignment
You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our written consent. We may freely assign these Terms and our rights and obligations hereunder in connection with any merger, acquisition, or sale of assets, or by operation of law or otherwise.
16.5 Waiver
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of such right or provision. Any waiver must be in writing and signed by our authorized representative.
16.6 Survival
The following sections will survive termination of these Terms: Definitions, Intellectual Property Rights, User Content and Uploads, Disclaimers and Limitation of Liability, Indemnification, Governing Law and Jurisdiction, Dispute Resolution and Arbitration, and General Provisions.
